Terms of service

1. What the service is

openmcp.app connects to an AI assistant you already use and lets it create small applications — we call them apps — that hold your data and that you can operate directly. We host those apps and their data for you.

You need your own account with an AI provider. We are not affiliated with, endorsed by, or acting on behalf of any AI provider, and we don’t control what their assistants do.

2. Your account

• You must be old enough to enter into a contract where you live.
• Keep your sign-in secure. Activity through your account is your responsibility.
• Your data is stored per organization. Anyone who is a member of your organization can see and change everything in it — that is how it is designed. Only add people you trust with all of it.
• You may close your account at any time. See Privacy for deletion.

3. Your content stays yours

You keep all rights to the apps you create and the data you put in them. We claim no ownership.

You give us only the permission we need to actually run the service: to store your content, to transmit it to you and to the AI assistant you connect, to render it, and to keep backups. That permission ends when you delete the content or close your account, except for backup copies still aging out on their normal rotation.

If you choose to publish an app so other people can see it, you are the one making it public — make sure you have the right to share whatever is in it.

4. What you can’t do

Don’t use openmcp.app to:

• break the law, or help anyone else do so;
• store or distribute malware, phishing pages, or content designed to deceive;
• impersonate a person or organization, or publish anything that pretends to be an official record, receipt, or communication when it isn’t;
• harass, threaten, or target anyone, or store material that sexualizes children;
• attack the service — no attempts to break isolation between accounts, exhaust capacity, bypass quotas, or reach systems you weren’t given access to;
• resell or repackage the hosted service as your own, or use it to build a competing hosted service (the engine is open source — see licensing — so build on that instead);
• store data you are not allowed to put on third-party infrastructure.

We may suspend or remove content or accounts that break these rules. Where we reasonably can, we’ll tell you why first.

5. Apps run in a sandbox — but judgment is still yours

Apps run inside a sandbox, and apps you didn’t write yourself run under further restrictions. That reduces risk; it doesn’t eliminate it.

An app your AI writes is generated code. Read what it does before you trust it with anything that matters, and don’t treat its output as advice — particularly for anything medical, legal, or financial. If an app calculates something you’re going to act on, check the arithmetic yourself.

6. Beta: things will change and things will break

• No service level guarantee. There is no uptime commitment during the beta.
• Features may change or disappear. We are still working out what this product is.
• Keep your own copies. We take daily backups and we take them seriously, but you should not rely on us as your only copy of anything important.
• We may end the beta. If we do, we’ll give you reasonable notice and a way to export your content.

7. Free now, not necessarily forever

The beta is free. If we introduce paid plans, existing free usage will not silently become billable — we’ll tell you what changes and give you a choice first.

8. Licensing and trademarks

The engine behind openmcp.app is open source under the AGPL-3.0, and the example components are MIT. You are welcome to self-host it. These terms cover the hosted service at openmcp.app only — they don’t restrict what the open-source licenses allow you to do with the code.

The names open-mcp-apps, openmcp.app, SecondFirst and 2nd1st, and our logos, are not covered by those licenses. Don’t use them for your own service or in a way that suggests we endorse it.

9. No warranty

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the service will be uninterrupted, error-free, or that any app it produces will be correct or suitable for your purpose.

10. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of your use of the service.

Because the beta is free, our total liability to you for any claim is limited to the greater of the amount you have paid us in the twelve months before the claim (currently nothing) or AUD $100.

Nothing here limits rights you have that cannot be limited by law. In some places consumer law gives you guarantees that no contract can exclude; where that applies, it applies.

11. Ending it

You can stop using the service and close your account at any time. We may suspend or terminate access if you break these terms, if we’re required to, or if we discontinue the service. On termination you lose access to the service; sections 3, 9, 10 and 12 survive.

12. Changes to these terms

If we change these terms materially, we’ll update this page and the date at the top, and we’ll tell you if the change reduces your rights. Continuing to use the service after that means you accept the new version.

13. Governing law

These terms are governed by the laws of Victoria, Australia, and disputes will be handled by the courts of Victoria — except where the law where you live gives you the right to bring a claim locally, which it may. Nothing in these terms excludes the consumer guarantees under the Australian Consumer Law that cannot be excluded.
